EXPULSION PROCEDURES

 

 

Procedures to be followed in the expulsion of a student shall be as follows:

 

  1. Any student who has committed any suspendable offense may be subject to expulsion if recommended by the principal of the school where the student is enrolled.

  2. Any student, after being suspended on three (3) occasions for committing drugs or weapons offenses during the same school year, shall, upon committing the fourth offense, be expelled from all the public schools of the system until the beginning of the next regular school year, and the student's reinstatement shall be subject to the review and approval of the School Board.

  3. If expulsion is recommended by the principal:

 

    1. The student may be immediately suspended by the principal if his/her continued presence in the school, pending the Superintendent's hearing, endangers persons or property or threatens disruption of the academic process.

    2. A hearing shall be conducted by the Superintendent or designee within five (5) school days from the date the student is given notice of the recommendation of expulsion made by the principal.

    3. Upon conclusion of the hearing, the Superintendent or designee shall determine whether such student shall be expelled or if other corrective or disciplinary action shall be taken.

    4. At the hearing, the principal and/or teacher concerned may be represented by a person appointed by the Superintendent.  The student may be represented by any person of his/her choice.

    5. Until the hearing takes place, the student shall remain suspended from school, if ordered by the principal in cases of danger or threatened disruption of school.

    6. It shall not be necessary to have witnesses sworn at this hearing.
